What does it mean? It has been a long time that the mobile industry has set in this world. It first started off with the features of devices. This is the third ecosystem that is emerging with a slow and steady pace. Nokia has surprisingly tied up with Windows to get their smartphones and to re-estabilish their position in the market. This phase is traditionally characterized by applications.

Going forward, the emerging phase is that of cloud services and streaming videos. The new era would be dominated by high-end applications and more complex end- to end experience including the cloud. Many mobile business systems will explore contextual cloud services hosted by others. In mature markets, including the U.S., smartphones will dominate device sales for the foreseeable future. Gartner analysts predicted. Many new device types such as tablets and e-book readers will emerge through 2012 but none comparable to the market share of smartphones and laptops. The smartphones market is very competitive with Apple’s OS (iOS) loosing to Google’s Android and onset of Windows

Oracle and SAP given June court date for TomorrowNow retrial

Oracle and SAP may be back in court on June 18 to begin a retrial of Oracle's corporate theft lawsuit involving SAP's former TomorrowNow subsidiary, according to a judge's order Thursday.

Oracle was awarded US$1.3 billion in damages from SAP last November as compensation for TomorrowNow's theft of software and support materials from an Oracle website.

SAP argued the sum was unfairly high, and the court agreed, overturning the jury's award. Oracle was given a choice of accepting a lower damages amount of $272 million or going into a new trial, and earlier this month it picked the new trial.

The two weeks starting June 18 are the only two weeks free on the judge's calendar this year, Judge Phyllis Hamilton of the Northern District Court of California said in her scheduling order Thursday. If Oracle and SAP reject that date, they can choose Aug. 13, 2013, or else hope an opening comes up before then.

It will be a busy year for Oracle in the courts. The company is fighting two other big cases that are due to go to trial this year. One was brought by Hewlett-Packard, over Oracle's decision to drop support for Itanium. The other is Oracle's suit against Google for alleged patent and copyright violations in Android.

Oracle buying Taleo for $1.9B in direct hit at SAP

Oracle is buying cloud-based talent management and employee recruitment software vendor Taleo for roughly $1.9 billion, the company announced Thursday. The move comes shortly after SAP's move to acquire SuccessFactors, a close competitor of Taleo, for $3.4 billion in a deal that has yet to close.

"Human capital management has become a strategic initiative for organizations," said Thomas Kurian , executive vice president, Oracle Development, in a statement. "Taleo's industry leading talent management cloud is an important addition to the Oracle Public Cloud."

The Taleo deal is expected to close in the middle of this year and is subject to shareholder approval, Oracle said. Taleo's board has unanimously approved the sale.

Taleo's applications focus on talent management, which includes areas such as recruitment, learning and development, and compensation and succession planning.

It remains to be seen exactly how Taleo's product portfolio will be aligned with Oracle's Fusion HCM (human capital management) software, which is also available as a cloud offering, and has some overlapping functionality.

Together, the companies "expect to create a comprehensive cloud offering for organizations to manage their Human Resource operations and employee careers," Kurian said in a letter to customers. The resulting products will "empower employees and managers to effectively manage careers throughout their entire employment, enable organizations to retain talent and optimize costs, and improve the employee experience through faster on boarding and better collaboration with team members via social media," he added.

Some 5,000 enterprises use Taleo's software, which also handles 15 percent of employee hires in the U.S., according to an Oracle document. About half of the world's top career websites run Taleo as well, Oracle said.

SAP has characterized the pending SuccessFactors purchase as something that will give the company needed "cloud DNA" and expertise in that market.

Oracle's announcement of the Taleo deal included no similar sentiments, but Taleo is its second major acquisition, along with customer-service vendor RightNow, of a cloud application vendor in the past six months.

Since SAP announced the SuccessFactors deal, speculation had run rampant that Oracle would make a move in response, with Taleo bandied about as a possible acquisition target.

Salesforce.com has also begun a push into human-resources software with its recent acquisition of Rypple, which focuses on employee performance management.

Unlike other software categories, the types of products sold by SuccessFactors, Taleo and Rypple have relevance to every employee in a company, allowing for more profitable large-scale SaaS (software as a service) deals.

There will likely be additional acquisitions in the HCM arena soon, said HR software analyst Naomi Bloom, managing partner of the consulting firm Bloom & Wallace. "I think we can expect that the boards of Cornerstone, of Ultimate Software, they are undoubtedly having conversations at least among themselves if not potential acquirers."

Oracle's move doesn't have "much to do with a technology buy," Bloom added. Instead, as with the acquisition of ERP (enterprise resource planning) vendor PeopleSoft, Oracle is looking to take out a competitor and gain a revenue stream, she said.

Taleo also has been running a SaaS business and has a lot of knowledge that will be beneficial to Oracle, Bloom said. While Oracle has long sold an on-demand CRM (customer relationship management) application, that experience isn't as relevant since unlike human resources, CRM isn't subject to government regulations and it impacts far fewer employees in an organization, she said.

Meanwhile, "if you are a Taleo customer, or God forbid are in the process [of becoming one], this should put ice water in your veins," Bloom said. "I have great regard for Oracle, they are an amazing financial machine. But if I'm a customer, I might look at it differently."

Oracle's announcement stated that it is currently reviewing Taleo's product road map, and that "any resulting features and timing of release of such features" are at Oracle's "sole discretion."

But Oracle has invested heavily in its Fusion Middleware and Fusion Applications as a next-generation software platform. Therefore, Taleo customers could expect some incremental improvements in the software over time, Bloom said. However, "if I entered into business with Taleo because I felt they were going to be a continuous innovation machine, that's not going to happen," she added.

The SuccessFactors and Taleo deals also could reflect growing concern on the part of both SAP and Oracle over the rise of Workday, which has landed large deals for its own cloud-based HCM software, Bloom said.

"I think Oracle was drawn in to having to do this deal," said Forrester Research analyst Paul Hamerman.

"I don't know why they didn't make this deal five years ago," he added. Oracle would have paid much less and would have primarily gained recruitment software, Hamerman said. But today, Taleo has built out the "four pillars" of talent management, namely recruitment, employee job performance, compensation and learning, he said.

While Oracle has had great success selling core HR applications for payroll, benefits and other areas, it hasn't had much luck with talent management, Hamerman said.

The overlap with Fusion HCM is not that significant, since it currently lacks recruitment, learning and succession planning capabilities, all areas where Taleo is strong, according to Hamerman. "It's actually a pretty complementary fit."

Making lame excuses for Microsoft's decision to drop the Start button in Windows 8

Over the past few days I’ve seem a number of Microsoft pundits come up with lame excuses to try to justify Microsoft’s decision to drop the on-screen Start button in Windows 8. Is there method ot Microsoft’s madness, or is the decision pure madness?

Here’s Paul Thurrott’s justification:

While it’s technically true that the Start button/Orb, which used to adorn the left end of the taskbar on the Windows desktop, is missing in action, most people are missing out on two salient points. First, the Windows desktop is not the primary user interface in Windows 8 anymore. That’s the Start screen.

Second, the Start button isn’t gone, and it’s not going away at all. In fact, it will be present on every single Windows 8 device sold going forward.

He goes on to post a picture of a physical Windows button on a tablet, and points out that a physical Windows Key is required for any PC or device to get the Certified for Windows 8 logo from Microsoft.

Well, I’ve got two counterpoints to Thurrott’s argument. First, and I’m surprised he didn’t mention this, it’s just the visual ‘orb’ hat’s being removed from the left-hand-side of the taskbar. There will still be an invisible hotspot in that part of the screen that does what the button currently does. Microsoft is kinda assuming that everyone will still go there looking for the Start button and will continue to offer the functionality, albeit without the UI.

Secondly, and I think that this is an important point - is a physical button a step forward or a step back compared to an on-screen button?

Before we answer that, let’s consider Apple’s iPhone and iPad. Neither of these devices have any sort of on-screen Home/Start button. Did Microsoft ‘copy’ Apple here? maybe, but that doesn’t matter. The difference is that the iOS platform has never had an on-screen Start/Home button. Windows, on the other hand, has had this feature since Windows 95, and people have come to expect it, so I expect that it’s removal (even if just the symbolic gesture of removing the UI element) will raise (and possibly knit) a few eyebrows.

Personally, I think that removing an on-screen UI element and replacing it with a physical button (a physical button that most systems already have) seems like a step backwards to me because it penalizes people who prefer using a mouse than a keyboard. I’m happy with the Windows key on keyboards, but the idea of having to rely on a physical button on a device that OEMs can put wherever they want puts me off because I know that OEMs can do boneheaded things. If Microsoft was bold enough to remove the functionality as well as the UI element, that would be one thing, but adopting some sort of halfway gesture seems like sitting on the fence to me, and all the lame excuses are just making that decision seem even lamer.

Either keep the Start button in or remove it completely.

Feds charge 7 in 'massive' case against Megaupload online piracy ring

A day after thousands of websites went on strike protesting controversial anti-piracy legislation in the U.S., federal authorities today announced they have busted a pirate ring that allegedly hauled in $175 million.

Seven individuals and two companies were charged with multiple counts of racketeering, copyright infringement, and money laundering, the U.S. Department of Justice (DOJ) said in a statement.

The two companies -- Megaupload Limited and Vestor Limited -- operated sites under the Megaupload name, including megaupload.com from servers located in the U.S., Canada and the Netherlands.

According to federal officials, the gang generated $175 million in revenue from advertising sales and premium memberships, and caused more than $500 million in damages to the legitimate copyright holders.

Among the pirated content the Megaupload sites distributed were movies, television programs, music, e-books and business and entertainment software.

"This action is among the largest criminal copyright cases ever brought by the United States," the DOJ said in a statement Thursday. Prosecutors also called the Megaupload group "an international organized criminal enterprise allegedly responsible for massive worldwide online piracy."

Of the seven men indicted by a Virginia grand jury earlier this month, four were arrested today in New Zealand by local authorities. The three others -- who live in Estonia, Germany and Slovakia -- remain at large.

Alongside today's arrests, the FBI also seized $50 million in Megaupload assets, and served 20 search warrants in the U.S. and elsewhere to grab the servers used by the websites.

A U.S. District Court also ordered the seizure of 18 domain names belonging to Megaupload.

According to the grand jury's indictment, Megaupload.com was seeing 50 million visitors daily and accounted for 4% of all Internet traffic.

The Alexa site ranking service currently lists the site as the seventy-second-largest in the world. Over the last three months, the site's visitors averaged 1.4% of all Internet users.

Today's arrests followed on the heels of a widespread "Internet strike" Wednesday, when thousands of sites, including Google and Wikipedia, went partially or completely dark in protest against the Stop Online Piracy Act (SOPA) and the Protect IP Act (PIPA).

Those bills -- drafted by the U.S. House of Representatives and the U.S. Senate, respectively -- are designed to make it easier for copyright holders to take down foreign websites that distribute pirated movies, music and software. Opponents, however, have argued that the legislation will give content owners too much power.

The seven men each face a maximum of 55 years in prison if convicted on all counts.

Rise in number of students getting a first or 2:1

The number of firsts and 2:1s awarded by UK universities has continued to rise, now accounting for almost two thirds of undergraduates completing their first degree.

This is among the facts established in new data from by the Higher Education Statistics Agency, which show that the proportion who gained a first or upper second “has shown a steady increase from 60 per cent in 2006-07 to 64 per cent in 2010-11”.

The figures also show that women scored better than men, with 66 per cent of their first degree classifications being firsts or 2:1s, compared to 61 per cent for men.

The overall number of student enrolments stood at 2,501,295 in 2010-11, according to Hesa, showing no percentage change from the previous year.

Postgraduate enrolments rose 2 per cent between 2009-10 and 2010-11.

The total number of first year undergraduate enrolments, meanwhile, stood at 1,145,970, a fall of 3 per cent on the year before.

While the number of full-time first-year enrolments showed no percentage change, part-time first-year enrolments fell by 8 per cent.

That may concern universities with large numbers of part-time students, as many observers believe the higher fee regime to be introduced this autumn will lead to a further fall in part-time numbers.

There was a significant rise in the number of student enrolments from outside the European Union (up 6 per cent), while the number of UK-domiciled students fell from 2,087,615 to 2,073,070, a 1 per cent decrease.

The data also show a sharp increase in the number of students studying wholly overseas for UK qualifications, up from 408,685 to 503,795.

Mozilla ponders demise of Firefox for Apple's Leopard

Mozilla is mulling the end of Firefox support for Mac owners running Leopard, the Apple operating system released four years ago, developer discussions show.

In a message Wednesday to a planning thread, Mozilla engineering manager Josh Aas proposed that the company pull the plug on Mac OS X 10.5 in six months.

"Maintaining Mac OS X 10.5 support consumes a non-trivial portion of the resources we have available for Mac OS X development," Aas said. "Not maintaining Mac OS X 10.5 support will allow us to devote more resources to the product as used by the majority of our Mac OS X users, those on Mac OS X 10.6 and 10.7."

Citing Mozilla's own data, Aas said that 24% of active Mac Firefox users currently run the browser on machines powered by Mac OS X 10.5, aka Leopard. By June 2012, when Aas suggested support stop, Leopard users should comprise only about 13% of Mac Firefox users.


Aas also noted that Apple itself has halted support for Leopard; it released the last security update for the 2007 operating system last June, several weeks before the launch of Mac OS X 10.7, better known as Lion.

The last time Apple updated its own Safari browser for Leopard was July 20, when it released Safari 5.0.6.

Apple typically stops issuing security updates for an older edition of Mac OS X when there are two successors available.

If Aas' plan is adopted, Firefox 13, now set to ship June 5, would be the last to support Leopard.

Although there were some dissenting voices in the discussion thread Aas kicked off, none objected to the eventual demise of Firefox support for Leopard, instead wondering when would be the best time to retire Mac OS X 10.5.

Some Leopard users have already been left behind by Mozilla. The open-source developer dropped support for PowerPC-equipped Macs earlier this year. Leopard is the newest Apple OS that runs on PowerPC, as opposed to Intel-based Macs.

Mozilla ditched Leopard's ancestor, Mac OS X 10.4, or Tiger, in early 2010 after the launch of Firefox 3.6.

Firefox fans have other options in the face of the looming retirement.

A group of developers calling themselves TenFourFox have created a browser built with Mozilla's code but fine-tuned for PowerPC Macs running Tiger or Leopard.

Camino, also built atop Mozilla's code, is another option: Camino runs on Tiger and later, and on both Intel and PowerPC Macs.

Both TenFourFox and Camino are free downloads.

RIM moves to higher mobile ground with BlackBerry Mobile Fusion: Is it too late?

Research in Motion on Tuesday outlined plans to launch BlackBerry Mobile Fusion, enterprise software designed to manage a bevy of mobile devices including the iPhone and Android smartphones.

With RIM’s smartphone share taking its knocks, the company can’t afford to rely on selling a complete mobile stack—BlackBerry device, BlackBerry Enterprise Server and RIM management software—-any more. BlackBerry Mobile Fusion will be available in March 2012.

The new plan for RIM revolves around focusing on what it does best for mobile device management software—asset management, configuration, security policies, group administration and centralized management. The challenge for RIM here is obvious: There are multiple mobile device management software providers and the BlackBerry Enterprise Server doesn’t have the lock-in it once did.

RIM appears to be trying to thread the needle between the bring your own device movement and selling its BlackBerry stack of mobile hardware and software.

How will this turn out? Here are three scenarios:

Best case: RIM’s focus on security and enterprise management puts it at the top of the mobile stack. RIM brings its security and enterprise management knowhow to a bevy of devices. RIM’s enterprise foothold gives it a leg up.

Middle-of-the-road case: RIM’s BlackBerry Mobile Fusion effort is a bit late, but manages to keep the company relevant even as it fades on smartphones. Companies loyal to the BlackBerry Enterprise Server naturally gravitate to Mobile Fusion. Other CIOs, however, look to other mobile device management suites offered by Sybase, Good and a bevy of other players that include Microsoft and Google.

Worst case: BlackBerry Mobile Fusion is viewed as a Hail Mary pass that comes too late. Technology executives begin to wonder why they need RIM as a mobile device management middleman when employees aren’t bringing BlackBerry devices to work.

It’s unclear how this BlackBerry Mobile Fusion effort will pan out. All of the cases outlined above are likely to have an equal probability of actually happening.

RIM’s move does remind me of a Clayton Christensen talk about innovation. Christensen, a Harvard professor, outlines innovation conundrums through the years. The common theme in multiple examples is how companies cede the lower ground in a market to move upstream to higher margin products. If you follow profit margin religion, you’re likely to outsource and give up on tough markets. The higher ground always looks better. It’s a bit of a stretch to argue that RIM is ceding the device market in a bid to move up the mobile stack, but the writing—beginning with Mobile Fusion—may be on the wall.

Better Windows support due on IBM mainframes

IBM mainframes will soon be able to manage Windows applications, bridging one of the last major divides in data centers.

IBM had already announced that it intended to deliver that capability with its zEnterprise 196 mainframe, but it recently said the Windows management function will be available on Dec. 16.

There are many Windows-based applications, including ones made by IBM, inside most data centers; they typically interact with mainframes to access data. Historically, all Windows software has had to be managed separately.

But now, IBM has promised, the security and speed of mainframe environments that include Windows systems will be improved. It will be possible to connect systems on a private network, thus avoiding some network hops and enabling the use of integrated management tools.

Joe Clabby, an analyst at Clabby Analytics, said the new features should reduce the labor required to run mainframe environments that have multiple operating systems. Moreover, he added, "if you can manage this as a single architecture, it saves money."

Greg Lotko, business line executive in IBM's System z division, said the addition of Windows support "is really recognizing that the world is heterogeneous."

Oracle: HP paying Intel to keep Itanium going

Hewlett-Packard has secretly contracted with Intel to keep making Itanium processors so that HP can maintain the appearance that "a dead microprocessor is still alive", and make money from its locked-in Itanium customer base and take business away from Oracle's Sun servers, Oracle said in a court filing on Friday.

The market has never been told that Itanium lives on because HP is paying Intel to keep it going, Oracle said. Intel's independent business judgement would have killed off Itanium years ago, it added.

HP however described the filing as a "desperate delay tactic designed to extend the paralyzing uncertainty in the marketplace" that it said was created when Oracle announced in March, 2011, in a breach of contract, that "it would no longer support HP's Itanium platform".

HP has made statements to the marketplace to the effect that Intel's commitment to Itanium is its own, based on its normal calculations for investing in processors that it believes have a future, Oracle said in a filing before the Superior Court of the State of California for the County of Santa Clara.

A public redacted version of the filing was made available to The Wall Street Journal's AllThingsD blog. Intel said it is not a party to the lawsuit, and therefore does not have any comment on it. "Intel does not comment on commercial agreements that we may or may not have with our customers," the chip giant said in an e-mailed statement.

Oracle also claimed that HP had kept secret from the market, but revealed in a filing two days previously, that HP and Intel have a contractual commitment that Itanium will continue through the next two generations of microprocessors.

HP's strategy behind its "false statements" about Intel's support for Itanium was to take away business from Oracle Sun, and "reap lucrative revenues from the locked-in Itanium customer base using HP's HP-UX operating system on Itanium servers", as the company gets few service contracts on operating systems like Linux that run on x86 processors, Oracle said.

Oracle acquired Sun Microsystems last year.

HP filed a suit in June over Oracle's decision to stop developing software for the Itanium processor, the chip used in HP's high-end servers, claiming that Oracle's decision violates "legally binding commitments" that it made to HP and the companies' 140,000 joint customers.

Oracle said at the time that HP tricked it into signing an agreement last September to continue its support for Itanium, even though HP knew of an Intel plan to discontinue Itanium. HP already knew all about Intel's plans to discontinue Itanium, and HP was concerned about what would happen when Oracle found out about that plan, Oracle said in a statement in June.

As Oracle well knows, HP and Intel have a contractual commitment to continue to sell mission-critical Itanium processors to customers through the next two generations of microprocessors, thus ensuring the availability of Itanium through at least the end of the decade, HP said in a statement.

"The fact remains that Oracle's decision to cut off support for Itanium was an illicit business strategy it conjured to try to force Itanium customers into buying Sun servers -- and destroy choice in the marketplace," HP said.

Firewalls fail to stem tide of DDoS attacks, survey finds

Companies still rely heavily on firewalls to defend themselves against denial-of-service attacks despite the fact that this class of device is often not up to the task, a new survey by F5 Networks has found.

The survey of 1,000 medium and large organisations in 10 countries found that up to 45 percent of respondents experience such attacks on a regular basis, a mixture of application and network-layer incursions.

About half rated denial of service attacks as highly effective with 79 percent saying they still relied on firewalls to deflect them despite 42 percent finding that such devices were ineffective against conventional attacks at the network layer.

The research also found that nearly half had detected attempts to access encrypted data on networks, with 44 percent noticing attacks against DNS servers, one of the most difficult-to-defend assets.

"Whilst many organisations can view insider threats as the most difficult to defend against, the research clearly demonstrates that external threats remain a potent force, and companies need to be aware of the most effective ways to safeguard themselves," said F5's technical director, Gary Newel.

Attacks on DNS servers were a clear worry, rated as being in the top three hard to repel attacks by a third of those asked.

The anxiety over DDoS attacks is far from new although exactly how to defend against it, not surprisingly, divides vendors.

Some see the best solution as being better routing infrastructure because routers are the first to handle DDoS packets as they move into a network. F5 is out to push its Big-IP Application Delivery Controllers which act in effect as load-balancing application firewalls. Another option is to use multiple layers and bundle the hardware level as a service.

During the recent launch of the Technology Operations Centre for the 2012 Olympic Games in London, organisers touted an array of security measures to counter the menace of a large DDoS disrupting content distribution from the global event.

BlackBerry finds safe haven in UK, despite a fall in sales

BlackBerrys, despite their once popular status across the U.S., Canada and Europe, have found a safe haven in exile in the United Kingdom, of all places.

It has been only a month since the BlackBerry global outage, which spread across four days and affected over half its worldwide user base, an estimated 50 million users. The press alone ripped a hole in Research in Motion’s communications strategy, which left BlackBerry users in some cases more frustrated than the outage itself.

But despite the odds, BlackBerrys retained high status and stormed ahead of both Nokia and Apple in the UK market, despite shipments declining 2 percent, as Apple’s iPhone fell by just over a quarter.

On a bright side, Samsung jumped 178 percent to 1.1 million shipments, and HTC grew by nearly half to 800,000 shipments.

While Nokia’s sales slumped the most by 87 percent to a meagre 130,000 shipments, Sony Ericsson fell 32 percent to just 300,000 shipments, after it was announced last month that Sony would buy out Ericsson’s share to take the venture into its wholly-owned arms.

Nokia hopes that, as many consider the company’s Symbian mobile operating system of choice is outdated or “perceived as dead”, Canalys senior analyst Tim Shepherd said, the Finnish phone giant is hoping to regroup with its Microsoft partnership as it rolls out Windows powered phones.

One of the reasons for Apple’s loss could be the lacking availability of the new iPhone 4S smartphone, with mobile phone contract renewal or upgrade dates falling at an inconvenient time. It is thought however that the Christmas holiday period will boost smartphone sales.

Plus, as many had hoped that the next-generation iPhone 5 would be out in September, many are still holding out for the model next year, skipping the iPhone 4S altogether.

Statistics from analytics firm Canalys show smartphone shipments declined by 7 percent to 5.3 million, with a mediocre performance across the major manufacturers.

Research in Motions’ marketshare has fallen below 10 percent, according to Shepherd, noting its 58 percent year-over-year drop in North America.

But in areas of high wealth, the United Arab Emirates for example showed a massive strong quarter of growth, up 181 percent to 1.4 million units shipped in the region.

But the outage alone did not deter loyal followers of the BlackBerry brand. The popular BlackBerry Messenger service was still a unique selling point for particularly the younger generation across Europe, though now rivalled by Apple’s iMessage service, which offers vastly the same function amongst iPhone and iOS 5 users.
